CLEVELAND, OH (WOIO) –

A Cleveland police officer facing criminal charges went before a judge Tuesday morning.

41-year-old David Mindek pleaded not guilty to one count of dereliction of duty.

On July 4, 2011, 27-year-old Daniel Ficker was shot and killed at his Wareham Drive residence located in Parma.

Cleveland Police Officers Matthew Craska and David Mindek went to Ficker’s residence to question him about his alleged involvement in a burglary that took place at Officer Mindek’s residence.

While Craska was questioning Ficker, a fight ensued between the two. After a shot was fired, Ficker was transported to MetroHealth Medical Center where he subsequently died as a result of his injuries.

Mindek remains free on bond.
