NEW YORK (WCBS/CNN) – New Yorkers can continue to buy super-sized sugary drinks after a judge says it’s not legal to ban them.

On Monday, New York Supreme Court Justice Milton Tingling ruled the law invalid. The lawsuit was filed by the American Beverage Association.

The ban was to go into effect on Tuesday, but the city did not plan to seek fines until June so businesses could adjust to the new rule.

The law, however, did not cover alcoholic drinks, milkshakes, coffee products or sugary drinks sold at grocery stores or convienence stores. The 7-Eleven Big Gulp would have been permitted under the law.

Businesses had already made adjustments for the new regulation.

Pronto Pizza shop owner Mary Cira was prepared to throw away bottles of soda.

“I definitely believe it’s going to hurt my business,” Cira said.

Over the weekend Cira got ready to toss nearly a $1,000 worth of 20 ounce and 2-liter bottles of soda, and she had plans to reprint her menus.

“I have a Sicilian get a two liter soda; I have a combo special with a two liter soda,” Cira said.

If you ask the mayor, those are not deals. He says soda leads to obesity.

Businesses that require a health department permit were required to clean house or risk a $200 fine.
