19 Action News Reporter Paul Orlousky has learned prosecutors in an attempted murder case are checking to see if Bratenahl Police lost a key piece of evidence in a shooting on I-90.
The shooting happened in March of 2010.
Jamil Ali allegedly ran a 25-year-old driver off the road, and shot him several times. The victim, Lee Collins, survived. Police believe the two men knew each other, and the shooting was not road rage related.
Prosecutors were told a key part of the evidence against Ali was a tape recording made by Detectives when they interviewed him while he was hospitalized at Northcoast Behavioral Center.
As Ali’s attorneys prepared to defend him, they wanted to hear the tape, but found that the tape was gone. Bratenahl’s Police Chief says there never was a tape and he’ll say so in court. He tells 19 Action News a former employee who was fired from the department made the story up and prosecutors ran with it.
Ali’s pre-trial is Wednesday, but unless the mystery confession appears the case could be thrown out.
