CLEVELAND, OH (WOIO) –19 Action News has learned that there has been significant movement in the Tamir Rice shooting investigation.

Cleveland Municipal Court Judge Ronald B. Adrine released an opinion Thursday stating that there is probable cause to charge Officer Timothy Loehmann with murder, involuntary manslaughter, reckless and negligent homicide and dereliction of duty. Police say Loehman shot Rice while he was holding an air soft pistol.

However, there is not enough probable cause to charge Officer Frank Garmback with murder but he could be charged with negligent homicide and dereliction of duty. Garmback was driving the cruiser the day 12-year-old Tamir was shot.
