CLEVELAND, OH (WOIO) –

A parking lot owner has filed a lawsuit against the city of Cleveland over lost business since roads have been closed due to the filming of Captain America.

The owners of the lot known as The Pit first took legal action in county court against the film producers. Last week at a court hearing, lawyers announced that had been settled.

They also took legal action the city, and they say they had been trying to reach a deal. Attorney Michael Blumenthal says that called for creating a task force for the next time a film is shot in Cleveland to look at ways to minimize the impact on businesses. That task force would include businesspeople, city leaders, and members from the film industry.

But we’re told that deal fell apart, so a lawsuit has been filed against the city for what Blumenthal calls the “violation of constitutional rights”. Ultimately a judge could force the city to pay the lot penalties for lost business.

In the past, City Hall has said it would defend itself for allowing the road closing permits.
